Matt Stein Joins LACBA Presentation on Elder Abuse in Real Property Transactions

Matt Stein presenting on Elder Abuse in Real Property Transactions

When real estate transactions raise red flags, understanding the legal implications can make all the difference.

Law Stein Anderson, LLP’s Matthew G. Stein recently joined Hon. Elizabeth Feffer (Ret.) and Shawn M. Ogle as a virtual presenter for the Los Angeles County Bar Association’s (LACBA) Elder Abuse in Real Property Transactions online program.

Drawing on his extensive experience in probate litigation, trust disputes, and elder abuse cases, Matt helped explore the legal complexities that arise when real estate transactions involve potential financial exploitation, undue influence, or questionable property transfers.

Recognizing Red Flags in Real Estate Transactions

Financial elder abuse can take many forms, including situations where an older adult is pressured, manipulated, or improperly influenced into transferring ownership of valuable property.

The presentation examined California’s legal framework for financial elder abuse, including Welfare and Institutions Code Sections 15610.30 and 15610.70, which address financial exploitation and undue influence.

Among the key topics discussed were:

  • Undue influence: Recognizing when an individual’s vulnerability, dependency, or relationship with another person may affect important property decisions.
  • Questionable property transfers: Identifying potential warning signs when real estate changes hands under suspicious circumstances.
  • Legal remedies: Exploring options for recovering property wrongfully transferred or taken through financial elder abuse.
  • Litigation considerations: Understanding when disputes may be addressed in probate or civil court, along with the challenges associated with each.
  • Protecting property interests: Examining title insurance concerns, documentation, and considerations when elder abuse allegations arise during a transaction.

The discussion also addressed California Probate Code Sections 850 and 859, which provide important legal mechanisms for pursuing property recovery and, in qualifying circumstances, additional remedies for financial elder abuse.

Bringing Probate Litigation Experience to the Conversation

As a probate litigation attorney and owner of Law Stein Anderson, Matt regularly handles complex trust and estate disputes, fiduciary matters, and elder abuse claims.

His experience navigating contested property ownership, allegations of wrongdoing, and high-stakes litigation brings a practical perspective to these issues.

The presentation also explored how attorneys can approach potential elder abuse cases, evaluate available remedies, and navigate disputes involving real property.

Continuing the Conversation on Elder Financial Protection

As real estate remains one of the most significant assets individuals and families own, understanding the risks associated with financial elder abuse is essential.

Through educational programs like this one, Matt and his fellow presenters help bring attention to the legal issues surrounding property transactions and the importance of recognizing potential exploitation.

At Law Stein Anderson, we are proud to see Matt sharing his experience with the broader legal community and contributing to important conversations about protecting older adults and their property rights.
